What laws make online notarization legal in New Jersey?
The Full Faith and Credit Clause allows notarizations performed in one state to still be valid in another. This clause also enables documents to be notarized online by a notary in one state to be valid in all other states. It is used in conjunction with the United States Electronic Signatures in Global and National Commerce (E-Sign) Act which, since enacted in the year 2000, recognizes e-signatures as valid in all states as well.
New Jersey-specific online notarization laws
In 2020, New Jersey introduced a temporary law under Executive Order 103 that allowed notary publics to perform online notary services. This made way for a permanent remote notarial law to be created the following year through Assembly 4250.
